A man who accuses Denise Richards’ estranged husband, Aaron Phypers, of making false promises to his dying wife is demanding a six-figure judgment in court, Us Weekly can exclusively report.
On Wednesday, November 19, Rupert Perry asked a Los Angeles Superior Court judge to award him a default judgment in the amount of $148,652 from Phypers, 53. Perry runs his late wife Elina Katsioula-Beall’s estate. The breakdown is $126,000 that Perry claims Phypers owed Katsioula-Beall, along with $21,000 in interest and other fees.
Perry claims he served Phypers with the lawsuit over alleged fraud and breach of contract, but he has failed to respond to the case.
In his original lawsuit, Perry explained his late wife was diagnosed with sarcoma cancer in 2019. He said none of the standard treatments worked, which led her to explore alternative treatments. He said they met with Phypers in June 2023 at his now-defunct wellness center.
Perry claimed that Phypers told him he had a treatment for her cancer that would “cure or at least ameliorate” her condition. The suit said Phypers said the treatment had a 98% success rate and he even offered a 50% refund if the treatment did not work. Katsioula-Beall paid Phypers $126,000 for the treatment.
The suit said Katsioula-Beall received treatments from July to September 2023, but they did not work. In December 2023, Katsioula-Beall’s tumor had grown 25 percent in the preceding three months. Perry said his wife wrote to Phypers requesting the 50 percent refund totaling $63,000. He suggested she undergo another round of treatment.
Perry said his wife then reached out again in February but did not hear back. “On March 29, 2024, as she was dying from cancer, [Katsioula-Beall] sent another email to [Phypers] along with an invoice for $63,000 and a request for payment in a timely manner. [Phypers] again ignored her request and did not respond, Perry said.
Katsioula-Beall died on May 21, 2024. Perry spoke to Phypers on June 28, 2024, who allegedly acknowledged the debt and offered excuses for not paying.
At the time, a source close to Phypers told In Touch that he was a middleman and believed the company that provided the service should be responsible for the refund. The source claimed Phypers had been attempting to contact the company’s CEO but had been unable to reach them. The judge has yet to rule.
Perry’s demand for the six-figure judgment comes as Phypers pleads for support in his ongoing divorce from Richards, 54. His request comes weeks after he was arrested on October 17 on charges related to alleged abuse against the RHOBH star.
In his recent filing, Phypers claimed, “My financial situation gets worse by the day.My pickup truck, which is now my only vehicle, is subject to repossession. I am in danger of eviction at any time. I am begging friends for money to have food to eat.”
“I now have criminal charges against me and I need to retain a defense attorney before my next hearing, which is in mid-December,” Phypers said. “I am in literal danger of being made homeless with no vehicle and no cell phone unless the hearing can be advanced to an earlier date and orders can be entered allowing me access to the substantial funds that are being controlled by [Richards].”
Phypers said “in order to survive” he needs $125,000 for past due rent, $2,673 for past-due vehicle registration, $17,820 for pickup truck payment arrears, $10,000 for past due HOA fees, $1,960 for storage fees, $3,500 for past-due water bill for reconnection, $12,000 for past-due electricity (“subject to shutoff”), $150,000 for legal fees and various other bills.
Phypers said his monthly fixed expenses for “basic living and survival” are $15,000 for rent, $12,000 for food and other expenses, $2,000 for his truck, $380 for truck insurance, $193 for internet and $300 for cell phone.
As Us first reported, Richards and Phypers were sued for eviction by their landlord on November 7. The suit accused the duo of owing over $80,000 in back rent. Richards moved out of the home in question in 2023. Phypers and his family have continued living in the home.
The lawsuit came the same day Richards was granted a permanent restraining order against Phypers. The actress testified that he had abused her multiple times during their marriage. Phypers adamantly denied the claims.
