Britney Spearsâ arrest has rocked the internet, after the pop star was taken into custody on Wednesday evening by the California Highway Patrol. The 44-year-old was seen driving âerraticallyâ according to a spokesperson from the police, and âshowed signs of impairmentâ before submitting to âa series of field sobriety testsâ.
âAt approximately 8.48pm, a black BMW 430i was reported to the CHPâs Ventura Communications Center for driving erratically at a high rate of speed on southbound US-101 near the Borchard Road exit in Newbury Park,â the spokesperson explained.
Britney was reportedly booked on a DUI charge, taken to Ventura County Main Jail in Los Angeles, and released at 6 a.m. the following morning. With the âToxicâ singerâs future now up in the air, many are wondering if this could mean jail time for Britney.
According to Los Angeles entertainment and trial attorney Tre Lovell, of The Lovell Firm, who spoke exclusively to HELLO!, there is a high chance that Britney will avoid jail time.
âFor Britney, there are a number of options that can occur based upon her DUI arrest. If this is her first DUI and there are no extenuating circumstances such as excessively high blood alcohol or resisting arrest, there is little chance she would serve time,â he said.
âRather, most likely she will face probation, a fine, a requirement to attend and complete a DUI education program, and potentially a suspended license unless she can convince the DMV otherwise at a DMV administrative hearing.â
âOnce she completes probation, pays the fines and completes any other classes or requirements, she can seek to have the charge expunged from her record,â he added. âIn addition, and prior to entering into any plea deal, the circumstances underlying the arrest will be important to ensure her constitutional rights were not violated, that police had reasonable suspicion to pull her over and probable cause to arrest.â

In the hours following Britneyâs arrest, her representative shared a statement on her behalf. âThis was an unfortunate incident that is completely inexcusable. Britney is going to take the right steps and comply with the law, and hopefully this can be the first step in long overdue change that needs to occur in Britneyâs life,â they said.
âHopefully, she can get the help and support she needs during this difficult time. Her boys are going to be spending time with her. Her loved ones are going to come up with an overdue needed plan to set her up for success for well-being.â
The incident comes just months after Britney sold her music catalog to independent music publisher Primary Wave for a reported $200 million.
The A-lister has endured a difficult number of years and was released from her conservatorship in 2021 following outcry from the public. She was originally placed under the conservatorship, controlled primarily by her father, Jamie Spears, and an attorney, in 2008, after a highly publicized mental health episode.
The mother of two also split from her husband of one year, Sam Asghari, in August 2023. They had been dating since 2016, and married shortly after her conservatorship ended.
