Kim Zolciakâs 15-year-old son, KJ Biermann, has officially been indicted in his sexual assault and sodomy case, according to court documents obtained by Page Six.
The teenager was indicted Thursday by a grand jury in Georgia on seven total charges â aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of aggravated sexual battery against a child under 16, and false imprisonment.
The charges stem from Biermannâs alleged acts against a victim under the age of 16 on April 23.
Biermann, according to the docs, allegedly committed âan immoral and indecent actâ to a victim under the age of 16 by âaggressively rubbing [her] vagina with the intent to arouse and satisfy his sexual desires.â
The alleged act caused âphysical injuryâ to the victim, the docs state.
Biermann also allegedly penetrated the victimâs âsexual organâ with his fingers and performed a sexual act involving his âmale sex organ and [the victimâs] mouthâ without her consent.
Additionally, Biermann was accused of âmaking physical contactâ with the victimâs âprimary genital area and âbuttocks,â again without her consent.
Lastly, he allegedly âunlawfully detained [the victim] without legal authority and
in violation of the personal libertyâ of the victim,â according to the details of the false imprisonment charge in the docs.
Page Six has reached out to Zolciakâs rep for comment.
The day before he was indicted, Biermann begged to be released from jail in documents filed by his lawyer, Jason B. Sheffield, who cited the teenâs good character, strong academics, football achievements and scholarship offers.
âHe is a high school student in good standing who has demonstrated strong academic achievement and regularly participates in extracurricular and community-based activities,â Sheffield said.
Biermann â born Kroy Jagger Biermann Jr. â was arrested on Aug. 17 after female classmate â who described herself as his âgirlfriendâs best friendâ â accused him of sexually assaulting her in the Life Time fitness center in Alpharetta, Georgia, Page Six previously confirmed.
The girl alleged that, while in a co-ed sauna, Biermann forced himself on her and attempted âmultiple times to have sexual intercourse with her by trying to pull down her pants,â despite her rejections.
She also accused Biermann forcing her to provide oral sex before he digitally penetrated her vagina, claiming that when she âfinally managed to get away from him ⊠he pulled up his pants and left.â
The girl was ultimately examined at the North Fulton hospital in Georgia. The April 24 examination, per the police report, showed no evidence of male DNA in her mouth or vagina.
Biermann denied the allegations via his lawyer, Jason Sheffield, who claimed in a statement to Page Six Friday that his client is â100% innocent.â
Scheffield also alleged Biermann âtried to present evidence to the arresting officer, including a passed polygraph by a notable and respected sex offender polygrapher,â and claimed he has âevidence of other prior false allegations by the alleged victim.â
Zolciak â who shares Biermann and his siblings Kash, 14, and twins Kaia and Kane, 12, with estranged husband Kroyâ also blasted the âreckless and deeply troublingâ allegations on Aug. 21.
âHe categorically denies ever being involved with this woman or engaging in the conduct she has alleged,â the âReal Housewives of Atlantaâ alumâs rep told Page Six.
